The ownership of the intellectual property rights to the developed software should be a concern for anybody commissioning bespoke development. We have a simple strategy for this: once you’ve paid the agreed fee in full, all rights are yours to whatever we’ve developed for you. Period.
The small print of some development contracts can be very much in favour of the developer, in that they retain intellectual property rights to whatever they’ve developed. They do this because it leaves the door open to exploit you at a later date, and if you plan to sell your business, can be a big nightmare for you. If you don’t own the intellectual property rights to something in use by your organisation, then your buyer’s legal team will use this as a way to reduce the price you get for your company.
